1. Agreement
These Terms of Service ("Terms") govern your access to and use of the Preset & Profit website and services (the "Service"), operated by Preset & Profit ("we," "us"). By accessing the Service or purchasing an audit, you agree to these Terms. If you don't agree, don't use the Service.
2. The Service
Preset & Profit provides business intelligence audits: an analysis of a business's public-facing presence and, where provided, additional context, resulting in a report containing scores, findings, and recommendations. The Service is informational. It is a tool to support your decisions, not a replacement for your own judgment.
3. No guarantee of results
We provide analysis and recommendations in good faith using our stated methodology. We do not guarantee any specific financial outcome, revenue increase, or business result. Revenue-opportunity figures are conservative, assumption-based estimates for planning purposes only — not promises, projections, or financial advice. Outcomes depend on factors outside our control, including your execution.
4. Not professional advice
The Service does not provide legal, tax, accounting, financial, or investment advice. Consult qualified professionals before making decisions based on an audit.
5. Your responsibilities
- You confirm you are authorized to request an audit of the website or business you submit.
- You agree to provide accurate information; estimates and findings depend on the quality of inputs.
- You agree not to misuse the Service, attempt to disrupt it, or use it to analyze a business unlawfully or without authorization.
6. Payment, plans, and refunds
Paid audits and plans are billed at the prices shown at purchase. One-time audits are charged once at the price shown. Subscription plans, where offered, are billed in advance on a recurring basis and renew automatically until cancelled; you may cancel at any time, effective at the end of the current billing period. Refunds and cancellations are governed by our Refund Policy.
7. Intellectual property
The Service, methodology, and site content are owned by us and protected by applicable law. The audit report we deliver to you is yours to use within your business. You may not resell, repackage, or redistribute our methodology or reports as your own except under an explicit agency or white-label agreement with us.
8. Confidentiality
We treat the non-public context you share for a paid audit as confidential and use it only to perform the Service, as described in our Privacy Policy.
9. Limitation of liability
To the maximum extent permitted by law, the Service is provided "as is," without warranties of any kind. We are not liable for indirect, incidental, or consequential damages, or for decisions made in reliance on an audit. Our total liability for any claim relating to the Service is limited to the amount you paid us for the audit giving rise to the claim.
10. Indemnification
You agree to indemnify us against claims arising from your misuse of the Service or your breach of these Terms.
11. Termination
We may suspend or terminate access for breach of these Terms or misuse of the Service.
12. Changes
We may update these Terms. Continued use after changes take effect constitutes acceptance. Material changes will be reflected by a new effective date.
13. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law principles.
